<br />I Installat',on of the conveyor and piping crossing over the Pullen D itch shall require
<br />a written agreement with the Fulton Irrigating Ditch Company. No mining shall occur
<br />wlthln the XceI right -of -way, 65' of the Inside top east bank of the Fulton Ditch, or
<br />wlthln 200' of any XCell tower, East 104th Avenue, or Brighton Road, except by prior,
<br />written agreement with the owner of each structure, Any written agreement for any lesser
<br />on tbac< In the above cases, shall be submitted to the Dl v l s l on of Minerals or l or to any
<br />excavation being undertaken In these special setback areas, Except in the above Instances,
<br />m'. nlmum setback shall be 35' from property line, and prior to mining being undertaken In

<br />tall grass areas adjacent to wetland areas that are disturbed during mining shat( be
<br />revegetated with Tall wheatgrass (Jose Variety) at a rate of 1t,0 tbs, /acre.
<br />3. Site mining above the lake elevation level will use dry mining techniques using
<br />backhoes, bulldozers, and simular equipment. No dewatering will occur, and below the
<br />water level, drag lines, backhoes, and /or dredges shall be employed For mining,

<br />Platte River Floodplain area shall be In an alignment parallel to the overflow direction
