The AFO inspector <br />was accompanied by an MLRD inspector. The inspection resulted in the <br />issuance of the TDN referenced above for alleged violations of the <br />Colorado rules. The TDN s:as dated September 18, 1991, and was received <br />by MLRD on September 23, 1991. AFO received MLRD's response on <br />October 2, 1991; therefore, AFO will consider this a timely response. <br />The alleged violation cites Colorado Rule 4.13 as the rule violated. <br />This rule states: <br />"Reclamation efforts, including, but not limited to, backfilling, <br />grading, topsoil replacement and revegetation, of all land that is <br />disturbed by surface coal mining operations shall occur as <br />contemporaneously ns practicable with mining operations." <br />MLRD's response states, in part: <br />"The portal was permanently sealed in May 1990. Shortly <br />thereafter, removal of facilities began and has continued through <br />this summer. * * * The reclamation plan in the approved permit <br />
