Please refer to the asterisked sentence on the fulowing page. Mr. Ray Crom owns the alluvial well within the amendment property we are proposing to mine. We are going to mine his property also: the property with the alluvuial well. We will not have to move the well prior to mining the amendment area, as the amendment area includes approximately 15 acres, of which Ray's property is only 2 arras. We will, of course, have to remove his well prior tG mining his :properly, but utstead of replacing the well at this time, wa will be pumping water to another well he i :owns that is located off of the property to be mined. We have submitted the agreement betwectt Asphalt Specialties and Ray Crom that allows us to mine Ray's property with the amendment application. IIe would not have signeed that abn'eemeni unless he was assttrred that we would take care of his alluvial water needs for irrigating his property. Please concur with this explanation in your Adaegttacy Review: that there should be no requirement 'that we move Ray's well prior to mining the amendment property. I wi I I further describe the aggreement that will be in place with UD&FCD prior to mitring within 100 ft. of the bank of the South Platte RIver in a separate Memo to be faxed today.
