III IIIIIIIIIIIII III <br />999 <br />Minutes, September 22-23, 1993 <br />DRAFT <br />Subject To Board Approval 36 <br />Staff said the site was inspected from March 30 through <br />April 2, 1993, along with the operator's representatives and <br />representatives from the OSM. Staff said the site was fairly <br />wet, due to the beginning of spring enowmelt, and that five <br />(5) NOVS were issued during the inspection. <br />Staff referenced a picture of the site conta ned in the <br />package of information and said that the area ~ which this <br />violation pertains is the Trout Creek Pump Pad. Staff said <br />the pad measures about 50 feet by 75 feet and is a dirt and <br />gravel surface pad. Staff said the Trout Creek Pump Station <br />is located on the pad. Staff said the pump is used to pump <br />water from Trout Creek into water trucks for use in dust <br />control on the mine site. <br />Staff said water was pooled on the pad area at the time of the <br />inspection. Staff said that drainage from the pad had drained <br />off of the southwestern portion of the pad and into Trout <br />Creek. Staff said there was no flow occurring during the time <br />of the inspection, but that there was evidence that the flow <br />had occurred. <br />Staff said that abatement of the violation required the <br />operator to submit, by April 20, 1993, a technical revision to <br />the currently approved permit, that would include plans to <br />treat runoff from the pad. Staff said the operator was <br />required to implement the plan within 15 days of approval, but <br />no later than July 4, 1993. <br />Staff said the technical revision was submitted on April 20, <br />1993, and approved on June 10, 1993. Staff said the plan <br />called for surfacing the pad with gravel and durable rock and <br />the installation of a silt fence on a portion of the pad. <br />Staff said the work was complete, as of the June 18, 1993 <br />inspection, with the exception of gravel surfacing. Staff <br />said that when the site was inspected on July 28, 1993, the <br />work had been completed and the violation was terminated. <br />Staff added that the Trout Creek Pump Pad is considered a <br />disturbed area, because topsoil and vegetation have been <br />removed. Staff said that at this point, the operator wants <br />the Board to find-that the violation did not occur. Staff <br />answered questions from the Board. <br />Mr. John Paul stated that the issue that should be resolved is <br />whether that area in question is considered a disturbed area <br />or a road. Staff said the operator's opinion is that the area <br />is a road and not subject to the regulations cited in the NOV <br />issued by the Division. <br />
