From the discussion I had with
Bill Schenderlein, I was informed that the primazy focus of this permit was to allow for the
mining of cells 4 and 5 of the Platte Valley Pit. Please know that, in and of itself, KMG has no
objections to the proposed plans. However, there is a concern that if cell 5 is too mined in the
future, the relocation of the concrete batch plant will have to be relocated. The logical place for
the concrete batch plant relocation will be in the processing plant site. Such relocation of the
concrete batch plant may create an encroachment issue with KMG's 8 inch pipeline which
currently resides in the processing plant site area. As such, prior to relocation, KMG would
require that the plant owner/operator contact us in order to avoid any detrimental encroachment
issues.
Thatilc you for your consideration in ties matter.
~- ... ~ , =
Very truly yours,
Kerr-McGee Gathering LLC
~~~ ~~
Matthew Miller
Pipeline Landman
