W., Suite 310 <br />Albuquerque, NM 87102 <br />RE: Ten Day Letter.lX-9U-02-250-001-TV3 Issued to New Castle Energy for the <br />Coal Ridge No. 1 Mine~(C-84-065) <br />Dear Mr. Hagen: <br />The Division would like to respond to Ten Day Letter (TDL) X-90-02-250-001 TV3 <br />issued to New Castle Energy's Coal Ridge No. 1 Mine (C-84-065) as a result of <br />a citizen's complaint filed by the Garfield Citizens Alliance. The TDL was <br />received in this office by fax on November 29, 1990, and certified mail on <br />December 3, 1990. <br />The TDL contains three alleges violations, all related to the presence of a <br />water supply pipeline at the Coal Ridge No. 1 Mine. This pipeline was <br />observed by AFO inspector Henry Austin and MLRD inspector Michael Savage on <br />October 23, 1990, while accompanied by members of the Garfield Citizens <br />Alliance. Upon investigation, it was determined that the water supply <br />pipeline was not addressed in the approved permit and that a portion of the <br />water line was outside the permit area. The Division does not agree with the <br />GCA assertion that a "pump house" was built and removed outside the permit <br />area. In any event, the Division required NCEC to revise the permit to <br />address the deficiencies (letter attached) and revise the permit. <br />Upon further consideration and in response to the GCA complaint and the TDL, <br />the Division has elected to issue NOV C-90=062 for: 1) conducting surface <br />coal mining and reclamation operations without a permit, 2) failure to <br />describe the location, construction, modification, use, maintenance and <br />removal of mine facilities in the permit area and 3) failure to confine <br />
