Ladies And Gentlcamen:
I would like to address the three possible violations brought
up in the June 7, 1984 letter and also the inspection report
of April 9, 1984.
1) Top Soil Stock Pile. Southwest Properties, Inc. will
commit t:o supply approximately 6 to 8 inches of top
soil for a two acre area around pit number 2.
Southwe:~t Properties will also supply any necessary
top soi:L for the area not under water in pit number 1.
Approximately 2 acres is the land area that will not
be under water when the mining operation is complete.
Pit numkrer 2 is acting as additional perculation pond
for the Forest Lakes Metropolitan District Sewage
Treatmerrt facility. At this time, I would like to
request a technical revision as to the location of the
stock p'.ling of top soil. The top soil we are commiting
is stoc}: piled in place approximately 1'~ miles from the
gravel bits. Our future development plan is to expand
our existing lake in the Forest Lakes subdivision, which
has alrEaady been used as a source of top soil by the
Forest bakes Metropolitan District. There is an ample
supply of top soil and will be available at all times
for rec].aimation purposes. The removal of this top soil
will not: disturb any additional lands. It will merely
deepen Bind expand our existing lake. In the event that
Southwest Properties is not able to reclaim the land in
pit 1 arsd 2, Southwest Properties will allow, by
execution of this letter, Mined Land Reclaimation Board
right oi` entry and access to this source of top soil in
order to complete the reclaimation process.
2) Total Acreage of Permitted Area. The original total
acreage of the permitted area for pits 1 and 2 was 7.74
acres. Southwest Properties has just completed a new
survey of the existing gravel pits and that survey shows
the existing disturbed areas to be 7.19 acres(see attached
