Long <br />Division Director <br />On December 16, 1999 we conducted an inspection of your mine and found evidence of damage outside <br />the boundaries of the approved permiUaffected area in the form of grading and sloping of lands into the <br />pit. <br />We believe this is in violation of C.R.S. 34-32.5-116(4)(1) which requires that azeas outside of the affected <br />(and shall be protected from slides or damage occurring during the mining operation and reclamation. <br />Therefore, we have found reason to believe a violation exists to Permit M-99-024 and the Law and have <br />scheduled [his matter before the Mined Land Reclamation Boazd. <br />A Formal Public Hearing will be held during the January 26-27, 2000 Board meeting for consideration of <br />a possible violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, <br />beginning at 9:00 a.m. or as soon thereafter as the matter can be considered, and you will have the <br />opportunity to be represented and heazd. <br />If the Board finds a violation at this hearing, it may issue a cease and desist order, assess a civil penalty in <br />the amount of 100.00 to $1,000.00 for each day of violation and may order the permit be suspended, <br />modified or revoked.
