CV-2001-016, The Division acknowledges the communication difficulties involved <br />in compie~ing the pre-blast survey prior to initiation of blasting operations. However, <br />this does not adequately explain, or remove, the responsibility of Lorencito Coal <br />Company to ensure 4hat all requested pre-blast surveys be completed prior 4d the . <br />commencement of blasting: <br />Regarding the publication timeframe of the blasting schedule, the Divisior reminded <br />Greystone (working on behalf of LCC) in a letter dated October 3, 2001 of the detailed <br />and specific Rules regarding blasting operations. One of the specific requirerrlents -- <br />under Rule 4.08 is the requirement to publish the blasting schedule during the 10-20 <br />day window prior to commencing blasting operations. <br />Based upon the information reviewed, I decline to vacate NOV CV-2001-016 •at this <br />time.
