Long
Divivon Director
RE: Request to Vacate, NOV CV-2001-016, Lorencito Canyon Mine, #C-96-084
Mr. Addington:
I have reviewed your letter received November 30, 2001, in part requesting vacation of
NO\! CV-2001-016, The Division acknowledges the communication difficulties involved
in compie~ing the pre-blast survey prior to initiation of blasting operations. However,
this does not adequately explain, or remove, the responsibility of Lorencito Coal
Company to ensure 4hat all requested pre-blast surveys be completed prior 4d the .
commencement of blasting:
Regarding the publication timeframe of the blasting schedule, the Divisior reminded
Greystone (working on behalf of LCC) in a letter dated October 3, 2001 of the detailed
and specific Rules regarding blasting operations. One of the specific requirerrlents --
under Rule 4.08 is the requirement to publish the blasting schedule during the 10-20
day window prior to commencing blasting operations.
Based upon the information reviewed, I decline to vacate NOV CV-2001-016 •at this
time. However, if additional information is provided during an assessmerit conference,
vacation of the violation can be reconsidered at that time.
Sincerely,
Michael B.
