EUnp <br />D rvis ion Dire~br <br />Re: Deserado Mine (C-81-018) <br />Review of violations <br />Rules 5.03(2)(b) and (c) of the Rules and Regulations require that <br />the Division Director promptly review the history of violations of <br />any permittee who has been cited for violations during three or <br />more inspections of the permit area within any twelve month period. <br />The review is to determine whether a pattern of violations exists <br />or has existed exists, whether we will require the operator to show <br />cause why the permit should not be revoked or suspended. <br />western Fuels - Utah was issued seven notices of violation during <br />three separate inspections of the Deserado mine. The citations, in <br />brief, were: <br />March 17. 1993 Inspection <br />NOV C-93-010 Discharge of coal fines into an ephemeral drainage <br />July 1, 1993 Inspection <br />NOV C-93-103 Failure to divert surface runoff from the fill <br />surface to stabili2ed channels of the fill <br />December 16. 1993 Inspection <br />NOV C-93-153 Failure to submit engineer-certified sediment pond <br />inspections <br />NOV C-93-154 Failure to construct and maintain diversions <br />according to permit design <br />NOV C-93-155 Failure to pass disturbed runoff through a sediment <br />pond or demonstrate SAE eligibility (vacated) <br />NOV C-93-156 Failure to compact coal refuse to 90% of maximum dry <br />density and to test compaction of lifts <br />
