Frei - Permit No. 83-33 <br />Dear Commissioners: <br />On December 24, 1984, the Mined Land Reclamation Division (MLRD) received a <br />letter from Mr. James Lucas specifying an expansion of the Albert R. Frei <br />operation "was inconsistent with County zoning". The matter being addressed <br />by Mr. Lucas was a Mined Land Reclamation Board (NLRB) approval of a technical <br />revision that swapped previously permitted acres for unpermitted acres. This <br />exchange of land was done to abate a previously NLRB issued Notice of <br />Violation for mine operations outside of the permit area. This technical <br />revision was approved by the NLRB at their May 23, 1984 meeting. <br />Upon receipt, Mr. Lucas' letter was immediately forwarded to the NLRB. At <br />their next meeting ( ie.: January 23, 1985), the NLRB considered the issued of <br />approving lands inconsistent with County zoning. After taking into <br />consideration testimony from Mr. Albert Frei, the NLRB, and telephone <br />conversations between Mr. David Shelton (MLRD Director) and Mr. Bert Weaver <br />and Mr. Peter Kenney, the NLRB passed the following resolution: <br />"The Board apologizes for the situation that has occurred and offers to <br />rescind the technical revision if Clear Creek so specifies." <br />The next meeting of the NLRB will be on February 27-28, 1985. If Clear Creek <br />wishes the NLRB to rescind the technical revision please notify us. <br />We have instituted new procedures to ensure that land swaps have proper County <br />zoning prior to NLRB consideration.
