Based <br />upon the conditions observed during this inspection, the Division concurs with <br />OSM's conclusion that problems did exist in the areas of availability of <br />records and a breach in the berm below the.loadout. <br />During the inspection, a discussion with I•tr. Tom McCormick indicated that the <br />operator was aware of these problems, and had already begun to take corrective <br />action. In addition, it was determined that there was no off-site damage taking <br />place. Therefore, no Notice of Violations were issued (see additional comments <br />in the inspection report).
