SHE LTO N, Director <br />DATE: October 23, 1986 <br />T0: Fred Banta <br />FROM: Peter O'Connor=,~~v <br />RE: Peerless Resources' Coal Gulch Mine - Pattern of Violations; Permit <br />C-84-067 <br />Based on the criteria in Rule 5.03.3, the following record of Peerless <br />Resources' Coal Gulch Mine is submitted for consideration fora pattern of <br />violations. Rule 5.03.3(2) specifies the following criteria for patterns of <br />violations. <br />(2) Patterns of Violations: <br />(a) The Division may determine that a pattern of violations exits <br />or has existed, based upon two or more inspections of the permit <br />area within any 12-month period, after considering all the <br />circumstances including: <br />(i) The number of violations, cited on more than one occasion, <br />of the same or related requirements of the Act, these Rules, or <br />the permit; <br />(ii) The number of violations; cited on more than one <br />occasion, of different requirements of the Act, these Rules, or <br />the permit; and <br />(iii) The extent to which the cited violations were isolated <br />departures from lawful contact. <br />A number of enforcement actions have been taken by the Division at this mine <br />site during the last year. These enforcement actions have been taken over the <br />course of two or more inspections and meet the criteria of <br />5.03.3(2)(a)(i)(ii)and(iii).
