Long <br />Division Duetlor <br />Please find attached, Seneca Coal Company's request to extend the abatement deadline <br />beyond 90 days for NOV C-95-023. The violation was issued October 16, 1995. The first <br />90 day period ended January 14, 1996. The violation abatement due date was first extended <br />to April 13, 1996 and again to July 12, 1996. Abatement requirements for the violation <br />included submittal of a technical revision (TR), and field implementation of the designs <br />approved in the TR following final approval by DMG. The drainage channel designs for <br />the upper section of 0006-NE-2 have been submitted to the Division and is currently under <br />review. <br />Rule 5.03.2(2)(c) list five circumstances which may qualify a surface coal mine for extension <br />of the abatement of deadline beyond 90 days. Approval of the TR following the close of <br />the 90 day period is one of the qualifying circumstances.
