This <br />request is based on discussions with Mr. Michael Long, which indicate that he, the Office of Surface <br />Mining, and the Colorado Mining Association are currently in negotiations which address the issue <br />Sun Coal Company was seeking a Declaratory Order to clarify. Rather than enter into a separate <br />clarification process with the Board, Sun Coal would prefer to evaluate the outcome of these <br />negotiations. <br />If Sun Coal Company believes, after review of the outcome of these negotiations, that the issue has <br />not been clarified with respect to Sun Coal Company's original concern, Sun Coal retains the right to <br />resubmit the request for a Declaratory Order. Further, if the negotiations do not proceed <br />expeditiously, Sun Coal anticipates resubmitting the Declaratory Order request, since the issue <br />addresses on-the-ground compliance. <br />Thank you and the Board for your cooperation in this matter. <br />Sincerely <br />~~~~~ <br />Bryan J.
