Barns, <br />Uvugn Drtagnr <br />This memo is to inform you of the current status of rt~y lead mines with respect <br />to permitting, violations, problems, upcoming actions, etc. <br />Colowyo - C-81-019' <br />The mine has recently had some enforcement problems dating back to early <br />October of 1989. The Division received a TDN with six separate issues after a <br />September oversite inspection. We issued 2 NOV"s C-89-025 and C-89-026 which <br />have went through the assessment and hearing process. A total penalty of 5750 <br />has been paid. A written response was issued to the OSM concerning the other <br />four TDN issues. Two were accepted and two rejected. The rejections were <br />appealed and sent back to OSM. The TDN's were upheld and it was requested <br />that the AFO re-inspect the site and determine if a violation still existed. <br />The OSM inspector claimed the violation did exist and the Division issued <br />NOY C-89-D37 for failure to maintain the 100-year diversion on Streeter fill. <br />Additional action is pending. <br />The mine is due for mid-term review by May 5, 1990. <br />The main permitting action this past year was a Technical Revision adding <br />- - Section it to the permit area. This was approved and consequently mining has <br />proceeded into this area. Other actions included a MR to relocate monitoring <br />wells, a MR for exploration drilling, MR for S4E, MR (still pending) to show <br />Taylor Pump Pond as a facility and an MR to do work on the Streeter diversion. <br />Empire Eagle No. 5 and 9 - C-87-044 <br />The mine has not received any violations since I became lead specialist in <br />-April. There has been sane ongoing debate about maintenance items and the <br />operator seems to be responding in the appropriate manner recently, <br />There were three TR's approved this year. TR-13 was the addition of a <br />multiple services building. TR-14 was the 100-year ditch design for the coal <br />waste pile and TR-15 revised reclamation monitoring. TR-10 is a revision <br />which was submitted in 1988 and finally approved this year with several <br />stipulations. It involves permitting a haul road across Trapper Mine's permit <br />area. This will not received final approval until a considerable amount of <br />additional information is submitted in response to the stipulation, The <br />operator is planning on submitting a revision to revise portions of the <br />surface water control system sometime soon (TR-16 ). We are also currently <br />undergoing bond release on the Craig Town Loadout. <br />
