BANTA, Dlrsetor <br />July 17, 1989 <br />Mr. Stephen Rathbun <br />Albuquerque Field Office <br />Office of Surface Mining <br />Reclamation and Enforcement <br />625 Silver Avenue SW, Suite 310 <br />Albuquerque, New Mexico 87102 <br />RE: TUNX-89-02-370-U02-iV2, North Thompson Creek Mine, (Permit C-81-025) <br />Uear Mr. Rathbun: <br />Tn1s letter supplements the Division's June 29, 1989 response to the <br />above-mentioned Ten-Day Notice. <br />In regard to alleged violation No. 1 (terms and conditions of tale permit, <br />failure to properly construct a diversion), the operator's representative was <br />contacted July 7, 1989 and requested to submit designs for the "Final <br />Reclamation" ditch for inclusion in the permit application document. These <br />will be submitted by July 15. As a result, the recognized permit defect will <br />be addressed. <br />A5 for ine adequacy of the ditch in place, I enclose a recent re-calculation <br />made by William Cr1ck of our office of the necessary dimensions fora ditch <br />sufficient io carry a two year precipitation event (the minimum required by <br />our Regulationsl. Such a ditch would oe triangular in shape with side slopes <br />of 2 to 1 and nave a depth of 1.14 feet and top width of 2.46 feet. Tnese are <br />essentially the dimensions of the ditch in place at the mine site. The <br />dimensions cited in our response dated June 25, 1989 differ from tnese as a <br />result of a calculation error made at toot time. <br />With regard to alleged violation No. 2 (terms and conditions of the permit, <br />failure to properly bacxfill the mine portals), the operator's representative <br />actually had been contacted prior io the tlate of the June 29, 1989 response <br />aoout the existence of the two holes and need for immediate repair but hand <br />repair nod not peen specified at toot time. In conversation with tfie <br />operators representative u y I it was established that filling of the <br />holes nod already Deen completed through use of a rubber tired backhoe and <br />that no appreciaole damage of the adjacent reclaimed area had occurred.
