Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Additional Comments-Richard Tremaine, River Valley Resources Amendment Application <br />Permit No. M-2001-090, Class: Revision, Type-Seq.: AM-1 <br />Dear Mr. Tremaine: <br />The Division has reviewed your letters dated September 9, 2003 (please see attached copies) and has <br />prepazed the following response to your inquiry and request for information: <br />0. The Division approved Lafarge West, Int.'s application for a regulaz 112 permit on September 12, <br />2002. Notice of such approval was sent to Lafazge West, Inc. Prior to approval of the application, <br />Lafazge West, Inc. had provided the Division with evidence of legal right of entry, including notice <br />from Jazle H,alsnes that he had reached a settlement agreement with the More Family Ranches, LLC <br />and Lafazge West, Inc. (Please see attached correspondence). The Division is not aware of any State <br />requirement or obligation to notify the local community of approval of Lafazge's regulaz 112 <br />application. <br />1. A copy of the Division's recommended decision document is attached. A copy of the Division's <br />rationale for decision document will be sent via sepazate letter. <br />2. Your clients, Mr. And Mrs. O'Dell aze no longer parties to this proceeding, per Rule 2.7.3(4), due to <br />their failure to attend or participate in the scheduled pre-Hearing Conference on August 28, 2003. <br />Attached is a copy of the Division's pre-Hearing Conference packet that discusses parties rights and <br />responsibilities. <br />3. There aze no minutes of summary of proceedings on September 4 or September 5, 2003 as there was <br />no event scheduled or held on either of these dates. Attached is a copy of Sandra Brown's August 28, <br />20031etter to the Colorado Mined Land Reclamation Board following your clients absence from our <br />scheduled pre-Hearing Conference. <br />4. The attached copy of the Division's pre-Hearing Packet (also mailed to you previously on August <br />Office of Office of Colorado <br />Mined Land Reclamation ~ Active and InaRive Mines Geological Survey <br />
