After <br />consideration of this information and the facts surrounding this <br />violation, I regret to inform you that I have decided not to vacate <br />this violation. <br />However, the information you provided is important and should be <br />considered prior to penalty assessment and, if you so choose, at <br />the assessment conference. You will be provided notice of the <br />proposed civil penalty in the near future. <br />The Division recognizes that Trapper Mine has had an outstanding <br />compliance record for many years.
