Long, <br />Division Director <br />Mr. Joe Kurt's <br />Public Works Director <br />City of Monte Vista <br />720 First Avenue <br />Monte Vista, CO 81144 <br />Re: City Gravel Pit (File No. M-92-060) Unpermitted Operation <br />Dear Mr, Kurt's: <br />On May 14, 1992, we conducted an inspection of your mine and found evidence of <br />mining in the form of excavated pits and stockpiles of gravel and overburden. <br />As was indicated to you at the time of the inspection, we believe this is a <br />violation of Section 34-32-109 of the Colorado Mined Land Reclamation Act, <br />34-32-101 et seg., C.R.S. 1973 as amended, which requires reclamation permits for <br />ali mining operations. Therefore, we have found reason to believe a violation <br />exists to the Law and have scheduled this matter before the Mined Land Reclamation <br />Board. <br />A Formal Public Hearing will be held during the May 27-28, 1992 Board meeting for <br />consideration of possible violation. The hearing will be held in Room 318 of <br />1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or as soon <br />thereafter as the matter can be considered, and you will have the opportunity to <br />be represented and heard. It will be reiterated that there is reason to believe <br />that you are in violation of the provisions noted above. <br />As was mentioned during the inspection, in order that this issue be heard at the <br />May 27-28, 1992 Board meeting, it will be necessary that the City of Monte Vista <br />waive its right to 20-day notification of this Formal Public Hearing. Please <br />provide such waiver, in writing, as soon as possible. Together with that waiver <br />the City should provide any evidence it may have that a permit is not necessary <br />for their operation by reference to applicable portions of Rule 1.11 of the <br />Mineral Rules and by following procedures indicated under Rule 1.13. <br />If you have any questions, please contact James C.
