The Division of Reclamation, Mining and Safety (Division) is required to make a decision by no later than <br />May 14, 2007. Therefore, your response to the following adequacy review concems should be submitted to the <br />Division as soon as possible. <br />Rule 6.3.3 Exhibit C- Minint+ Plan <br />Section (h) of tMs rule requires the Applicant to specify how much water will be used in coujunction with the <br />operation, and the source of this water. The materials submitted with the application indicate that there will be an <br />increase in water use related to the crusher. Please supply the information requested in this section of Rule 6.3.3. <br />Please be advised that the SAKO Excavating, LLC, 1 ] 0(c) Technical Revision Application may be deemed inadequate, <br />and the application may be denied on May 14, 2007 unless the above mentioned adequacy review items are addressed <br />to the satisfaction of the Division. Responses to these adequacy concerns must be received by the Division to allow <br />adequate time for review prior to the decision date. If you feel more time is needed to complete your reply, the <br />Division can grant an extension to the decision date. This will be done upon receipt of a written waiver of your right to <br />a decision by May 14, 2007 and request for additional time.
