Existing Bond: none <br />Grand County <br />Nature and Duration of Violation: The operator met with the <br />Division on January 13, 1995 and reported that they recently <br />discovered that this operation did not have a State reclamation <br />permit. Mr. Clark Branstetter stated that the County has operated <br />this pit on an intermittent basis for the past few years under the <br />belief that it was permitted with the State. The operation is <br />currently permitted with the Bureau of ~eclamativn. The purpose <br />of the meeting was to report this oversight~nd submit an <br />application for a permit. /1G ~ <br />This pit is located at the end of County Road 107 about 9.5 miles <br />southwest of Kremmling, Colorado. The land is owned by the U.S. <br />Bureau of Land Management. <br />On-site disturbance included a pit and topsoil and gravel <br />stockpiles. There was no equipment in the pit during the <br />operation and no mining activities were being conducted. The <br />total disturbance is approximately 4 to 5 acres. <br />eeriousaess: Zones <br />0-2 Acres 2.1-9.9 Acres 10+ Acres <br />$3,000 000 $60,000 <br />History of Violations in Past Twelve Months: None <br />Staff Recommendation: <br />Violation: Find a violation of C.R.S. 34-32-109(1) <br />and (2) for mining without a permit. <br />Cease and Desist: Recommended for the areas disturbed by <br />the mining operation. <br />Corrective Actions: Submit a complete application no later <br />than February 13, 1995 (this has been <br />done) and obtain an approved permit from <br />the Division no later than March 13, 1995 <br />if it is a 110 permit and no later than <br />May 13, 1995 if it is a 112 permit. <br />Civil Penalty: $9,000 based on 2.1 to 9.9 acres <br />disturbed. Because this was discovered <br />through an audit and was brought to the <br />Division's attention by the operator, the <br />Division recommends that no civil penalty <br />be assessed. <br />
