M-1999-034 ~ Natural Resource Trustee <br />Members of the Board: <br />Board consideration of the Division's recommendation for approval over objections for the above application is scheduled for a <br />Formal Public Hearing during the Board's June 25, 2003 Meeting. <br />The Division recommends that [he Boazd approve Aggregate Industries- WCR, Ines application for Amendment No. 1 with one <br />condition. The condition is as follows and has been agreed to by Aggregate Industries. <br />CONDITION OF APPROVAL <br />No de-watering or extraction activities will occur until Aggregate Industries develops a plan to monitor the gravel pit pond water <br />for diisopropylmethylphosphonate (DIMP) and obtains approval of that plan from the Division of Minerals and Geology. The plan <br />will include monthly sampling and analysis to begin immediately after de-watering and/or extraction activities are started. The <br />monthly monitoring will continue for one year and then will change to quarterly monitoring until the Division issues a letter <br />authorizing discontinuance. The plan will include the sampling and analytical methods to be used and an agreement to submit the <br />results of the analysis to the Division within 30 days of the sampling date. The samples will be obtained and analyzed by a <br />company, individual, or agency certified to do the work. If an analysis shows a level of DIMP exceeding Sug/L, Aggregate <br />Industries or its agent will immediately notify the Division by certified mail and include a response plan to deal with the <br />contaminant, and to prevent on-site and off-site damage.
