Members of the Board:
Board consideration of the Division's recommendation for approval over objections for the above application is scheduled for a
Formal Public Hearing during the Board's June 25, 2003 Meeting.
The Division recommends that [he Boazd approve Aggregate Industries- WCR, Ines application for Amendment No. 1 with one
condition. The condition is as follows and has been agreed to by Aggregate Industries.
CONDITION OF APPROVAL
No de-watering or extraction activities will occur until Aggregate Industries develops a plan to monitor the gravel pit pond water
for diisopropylmethylphosphonate (DIMP) and obtains approval of that plan from the Division of Minerals and Geology. The plan
will include monthly sampling and analysis to begin immediately after de-watering and/or extraction activities are started. The
monthly monitoring will continue for one year and then will change to quarterly monitoring until the Division issues a letter
authorizing discontinuance. The plan will include the sampling and analytical methods to be used and an agreement to submit the
results of the analysis to the Division within 30 days of the sampling date. The samples will be obtained and analyzed by a
company, individual, or agency certified to do the work. If an analysis shows a level of DIMP exceeding Sug/L, Aggregate
Industries or its agent will immediately notify the Division by certified mail and include a response plan to deal with the
contaminant, and to prevent on-site and off-site damage. If the Division determines from the monitoring data that there is
reasonable potential for the operation to cause groundwater quality standards for DIMP to be exceeded, [he Division will notify
Aggregate Industries to modify [he permit as necessary [o comply with Subsection 3.1.7 of the Rules.
Attached to this letter is the Division's Rationale for Recommending approval over objections.
