Long <br />, Division D~retlor <br />RE: Meadows #1 Mine (C-81-029) <br />Request for Declaratory Order <br />Request for Formal Public Hearing <br />Notices of Violation No. C-94011 and C-94-012 <br />Dear Mr. Archer: <br />We have received copies of your requests for the above mentioned Mined Land Reclamation <br />Board actions. Consideration of your request for a Declazatory Order has been placed on the <br />Board agenda for the August 23 and 24, 1994 meeting. <br />Your request for Formal Public Heazings regarding the above mentioned notices of violation <br />has been tentatively placed on the same Board meeting agends, pending receipt of penalty <br />payments for placement in an escrow account. Pursuant to Rule 5.04.4(1), when requesting a <br />formal public hearing Sun Coal Company must forwazd the amount of the fixed civil penalties <br />to the Division and submit a written request to the Board for a public hearing. The Division <br />has not yet fixed the civil penalties, in that ten days have ^ot elapsed since the close of the <br />assessment conferences. The assessment conferences were closed on the date the summaries <br />of which were signed by the Conference Officer, which was July 25, 1994. If the Division has <br />not received signed acceptance forms for the settlement agreements by August 5, 1994, then on <br />or before September 4, 1994 the Division will send notices of the faced penalties and orders to <br />pay same. Once the penalties have been fixed, to proceed with the request for public hearings, <br />Sun Coal Company should submit those amounts to the Division for placement into an interest <br />bearing escrow account.
