Long <br />Division Dircdor <br />The Colorado Division of Minerals and Geology received Ten-Day Notice No. <br />X-95-020-179-001 TV-2 on April 17, 1995. This notice applies to the Raton Creek Mine and <br />was issued in response to a Phase I Bond Release Inspection conducted on March 8, 1995. <br />The Division wishes to respond to the two issues identified in the Ten-Day Notice. <br />1. Failed to resrore strewn channel to near origrna[ condition as per Section 4.05.4(4). Section <br />of 8 ft. cuh~crt near shop. <br />Part One of the Ten-Day Notice states that the operator has failed to restore the <br />Starkville Gulch ephemeral stream channel to near original condition, per Rule 4.05.4(4) <br />of the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining, for <br />that portion of a permanent stream channel diversion containing a culvert. The Division <br />disagrees with this statement. <br />Rule 4.05.4(4) allows for the construction of permanent stream channel diversions when <br />those diversions approximate the pre-mining channel configuration, do not diminish <br />downstream water rights, and blend with the undisturbed drainage above and below the <br />area to be reclaimed. Rule 4.05.4(4) further allows the construction of permanent stream <br />channel diversions when the affected stream gradients are reconstructed with a stable <br />IDngitudinal profile, the channels are reconstructed to approximately the natural meander <br />STATE OF COLORADO <br />
