SHELTON, DlnMOr
March 27, 1984
Mr. Vance Mills
Trinidad Basin Mining, Inc.
P.O. Box 783
Trinidad, Colorado 81082
DIVISION
Re: Request for Extension of March 31, 1984 Deadlines Contained on NOV's
CV-84-027 and CV-84-029
Dear Mr. Mills:
The Division cannot grant your request for extension of the March 31, 1984
deadlines contained 1n NOV's CV-84-027 and CV-84-029 for the following reason:
The Division is particularly concerned with proper containment and detention
of water from disturbed areas. Given that the Trinidad area has received
large amounts of winter precipitation this season, the Division 1s especially
concerned that the sediment control system and road drainage structures are 1n
good condition and functional prior to the initiation of spring melt and
runoff. To delay correction of problems with these systems will only Increase
the possibility that they may not be in adequate condition to handle this
spring's runoff.
As further point, let me remind Trinidad Basin that failure to meet the
abatement deadlines set forth 1n the Notices of Violation will result in
minimum civil penalty of 5750.00 per day for each day the violation(s) remains
unabated.
If you have any questions or if I can be of any further assistance please feel
free to call.
Sincerely,
Michael S.
