C-85-062 <br />Dear Dan: <br />SEP 1 2 ~5 <br />MINED LAND <br />RECLAMATION DIVISION <br />Notice of Violation C-85-062 was issued for failure to minimize erosion <br />to the extent possible on redistributed topsoil, resulting in. areas of sediment <br />deposition and rill erosion. The abatement procedures required are as <br />follows: <br />1) Install diversions or drainage ditch as appropriate to preclude <br />future erosion and siltation in the reclaimed area <br />2) Repair and reseed areas of erosion and sediment deposition <br />Yampa Mining Co. has installed a diversion berm and drainage ditch along <br />the edge of redistributed topsoil. Additionally, contour furrows have been <br />graded across the slope above the effected area to prevent future erosion. <br />Susan Mowry of CMLRD conducted a partial inspection of the mine on August <br />27 and noted the drainage ditch in her inspection report. A copy is enclosed <br />of her comments regarding the NOV. <br />Yampa Mining Co. has not repaired or reseeded the area of sedimentation <br />because vegetation is becoming established in the area and we feel that more <br />harm would be done in the reparative process than any benefit that may be achieved. <br />In addition, the diversion and drainage ditch insure that the problem will not <br />reoccur. <br />On the basis of the information submitted and the comments made by Ms. Mowry, <br />we feel that the abatement procedures have been fulfilled, and request that <br />the area be inspected to confirm that our actions have been adequate. <br />We would appreciate haste in this matter as revegetation work is currently <br />in progress and the deadline for abatement is September 20.
