C-85-062 Dear Dan: SEP 1 2 ~5 MINED LAND RECLAMATION DIVISION Notice of Violation C-85-062 was issued for failure to minimize erosion to the extent possible on redistributed topsoil, resulting in. areas of sediment deposition and rill erosion. The abatement procedures required are as follows: 1) Install diversions or drainage ditch as appropriate to preclude future erosion and siltation in the reclaimed area 2) Repair and reseed areas of erosion and sediment deposition Yampa Mining Co. has installed a diversion berm and drainage ditch along the edge of redistributed topsoil. Additionally, contour furrows have been graded across the slope above the effected area to prevent future erosion. Susan Mowry of CMLRD conducted a partial inspection of the mine on August 27 and noted the drainage ditch in her inspection report. A copy is enclosed of her comments regarding the NOV. Yampa Mining Co. has not repaired or reseeded the area of sedimentation because vegetation is becoming established in the area and we feel that more harm would be done in the reparative process than any benefit that may be achieved. In addition, the diversion and drainage ditch insure that the problem will not reoccur. On the basis of the information submitted and the comments made by Ms. Mowry, we feel that the abatement procedures have been fulfilled, and request that the area be inspected to confirm that our actions have been adequate. We would appreciate haste in this matter as revegetation work is currently in progress and the deadline for abatement is September 20. Thank you for your consideration in this matter.
