These comments are preliminary, however, because Trapper has
been unable to fully investigate the circumstances surrounding the violation alleged in the
NOV. Trapper expects to present additional information as it becomes available to
contest the validity of the alleged violation and the amount of any civil penalty proposed.
On May 4, 1995, Trapper personnel discovered a slide in the Ashmore Scraper Pit
area, which was regraded and topsoiled in 1993. The slide area is wholly contained
within Trapper's permit area and did not threaten or cause damage to any other structures
or resources. It was reported to the Division by Trapper personnel by telephone on May
5. Trapper's report prompted the Division's inspections on May 17, 23 and 24, 1995,
which led to issuance of the NOV on May 30, 1995.
5 KIRK INGEBRETBEN
DOUGLABP RUEGSEGGER
EDWARD D WHITE
PEGGY J.
