I would like to bring this issue to closure by <br />June 30. <br />The way I see it, there is a substantial likelihood that <br />completion of the shaft was at least partially responsible for <br />lowering the water level in the area of the Tatum well. This is <br />borne out in my mind by the fact that the collar of the shaft <br />continues to leak. <br />Therefore, I am prepared to issue Basin a violation for failure <br />to minimize damages to a water well (4.04 (6)) and for failure to <br />minimize impacts to the hydrologic balance (4.05). I recall that <br />I made the company aware of such an eventuality during a <br />conference call which you and I had with Basin and its attorney <br />some time ago. <br />As an abatement, Basin would be required to either re-complete <br />the existing well so that it can provide adequate flow (quantity <br />and quality) for domestic use, or drill and complete a new well <br />for the same purposes, or provide for long term replacement <br />through a mechanism which is acceptable to Mr. Tatum. <br />Please contact Basin and let them know that we will issue a <br />Notice of Violation with the above abatement steps on June 27, <br />1994. However, I will rescind this decision if a completed <br />agreement between Basin and Tatum is achieved and received in our <br />office by June 24, 1994. <br />Due to the possibility that this action may result in litigation, <br />please route any correspondence pertaining to this matter to <br />Steven Brown. Likewise, any contact with attorneys representing <br />either Tatum or Basin should be routed to Steven Brown. <br />CC: Michael Long <br />Joe Dudash <br />Steven Brown <br />
