Dept ofN~tunlResaUrcet <br />1313 Sherman Street <br />423 Centennial Building <br />Denver, Colorado 80203 <br />RE: Alleged NOV C-84-169, <br />CMLRD File No. C-84-062 <br />Dear Ms. Baldridge: <br />Colorado Yarripa Coal Company (CYCC) would like to submit additional <br />information to the CMLRD in regard to NOV C-84-169 issued on November 20, <br />1984, for failure to salvage topsoil prior to placement of the western- <br />most overburden stockpile at Mine 3. <br />CYCC has enclosed pictures of the area and a map which shows the <br />overburden stockpile and delineates the numbered locations and directions <br />of the pictures taken. <br />The area examined during your November 8th inspection is indicated <br />in picture #3. CYCC feels that the soil mentioned in your NOV is not <br />topsoil, but a soil medium found below the topsoil layers which had been <br />previously stripped and stored in a stockpile south of the overburden <br />pile. The vegetation encountered in the buffer zone was volunteer spe- <br />cies from natural vegetation sites located upslope from the spoil pile. <br />As indicated in Section 4.06.1 of CYCC's original Mine No. 3 permit, <br />all topsoil and subsoils were removed to a depth of approximately 20 <br />inches. <br />The dozer tracks along the road embankment were caused by the care- <br />ful clearing of the spoil away from the embankment. By pushing the spoil <br />back towards the pile and away from the buffer zone, we would reduce de- <br />gradation and allow for the feathering back of reapplied topsoil. <br />A second inspection was conducted by Susan Mowbry, CMLRD, on Novem- <br />ber 21, at the request of CYCC and Mike Long of CMLRD. After an on-site <br />inspection of the disturbed area and surrounding terrain, Ms. Mowbry in- <br />dicated that a buffer zone was present and the material in question was <br />not topsoil. <br />
