Cattany <br />Acting Division Director <br />RE: City of Fort Collins File No. M-1977-184 <br />Timberline Pit 112c Amendment Application AM-2 Adequacy Review <br />Dear Mr. Walsh, <br />Listed below aze adequacy review comments for the Timberline Pit Amendment Application, File No. M-1977-184, The <br />Division of Minerals and Geology ("Division") is required to make an approval or denial decision no later than January 6, <br />2003, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as <br />possible. <br />1. As required by Rule 1.65 (2), please submit the proof of publication of the public notice circulated in the local <br />newspaper and all owners of record of surface lands, and easement holders that aze on the affected land and within 200 <br />feet of the boundazy of the affected land. Proof of notice ntay be return receipts of a Certified Mailing or by proof of <br />personal service. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />2. Exhibit E is defined as the Reclamation Plan. The Applicant shall include the following information: (2)(a) A <br />description of the type(s) of reclamation the Operator/Applicant proposes to achieve in the reclamation of the affected <br />land, why each was chosen, the amolmt of acreage accorded [o each, and a general discussion of methods of reclamation <br />as related to the mechanics of earthmoving. The application does not specify the amount of acreage that will be affected <br />by the change in post mined land use. Please specify how many acres of the site will be reclaimed as <br />industriaUcotnmercial, and the number of acres that will be reclaimed for recreational post mined land use. <br />Please be advised that the City of Fort Collins 112 Amendment Application may be deemed inadequate, and the application <br />maybe denied on January 6, 2003 unless the above mentioned adequacy review items are addressed to the satisfaction of the <br />Division. If you feel more time is needed to complete your reply, the Division can grant an extension to the decision date. <br />This will be done upon receipt of a written waiver of your right to a decision by January 6, 2003 and request for additional <br />time.
