Cs ~v.cr~s"~`/ <br />Thank you for your help on my previous slurry wall and bonding questions. As I mentioned, during a <br />recent meeting where we reviewed the progress of our mine amendment application, a few more <br />questions came up on phasing, bonding, and slurry walls versus clay liners. Because I have a few <br />questions with multiple parts, I felt it would be easier if I wrote them down for you, and then we could <br />get together (in person or on the phone) to go through them. <br />And now a little background information before I ask the questions: <br />1. With our amendment that we are currently pulling together, we have 7 separate property owners, <br />who own a total of 9 parcels of land, for a total of about 210 acres. <br />2. We would like to mine the amendment acreage in 5 different phases. <br />3. We have a signed agreement with each landowner, "Permission to Enter, Mine, and Reclaim," a <br />copy of one is attached for your reference. <br />4. We have 1 lease/sale agreement with 1 landowner (who owns 2 parcels). We do not have <br />lease/sale agreements with any other landowners at this time, but that is our goal. <br />5. We want to reclaim all the phases as water storage reservoirs. <br />Now, the questions: <br />1. Is the "Permission to Enter, Mine, and Reclaim" agreement adequate for permitting purposes? (I <br />am sending a blank one as an attachment) <br />2. Can we specify the mine phases (acreage), but not specify the sequence in which we mine from <br />phase to phase? We could inform the DMG of what phase we are moving into, prior to starting a <br />new phase. <br />3. Can we specify that we are reclaiming each parcel as water storage reservoirs, but not specify <br />whether we will do slurry wall or clay liner in the permit? Could we instead specify which method <br />prior to going in to each new phase? <br />4. We would like to have phased bonding. Could we spell out the bonding required for each mining <br />phase separately in the permit and then float the bond from phase to phase? <br />5. Could we specify bonding for each phase for both a slurry wall or clay liner, and then prior to <br />starting the phase we inform the DMG to ensure the proper bond is covering our operations? <br />These questions may bring up other questions, but that's all I have for now on phasing of mining and <br />bonding. <br />One mare question on a separate topic -man-made structure agreements: <br />- We will need to get aman-made structure agreement with Weld County for Weld County Road 18. <br />4/28/2004 <br />
