On January 19, 2005, the Division of Minerals and Geology reviewed your 112 Construction Materials Reclamation
Permit Amendment Application package, Revision No. AM-2, for the Connell Resources, Inc.'s Glass Grovel Pit,
Permit No. M-1981-022. Preliminary review of the information received detemmined that the following items must be
received before the Division can consider your application as being submitted and technical review can begin:

of Notice of the Application to the local Board of County Commissioners and, if the mining operation is within
the boundaries of a SoIl Conservation District, to the Board of Supervisors of the Soil Conservation District.

or receipt indicating the date on which the application was placed with the local County Clerk and Recorder.

demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected
land will not be adversely affected. The Division cannot accept the statement that the operator will not
adversely affect the stability of any significant, valuable or pennaneFrt man-made structures. The operator must
either provide information sufficie~ to demonstrate that the stability of any structures will not be adversely
affected or an agreement with the owners of the structures. The Division can accept a signed notarized
statement from the operator stating that they will stay at least 200 feet away from the structures u~.il an
agreement is submitted to the Division.
Your application will not be considered submitted until the information listed above is received and found sufficiemrt to
begin our review. A decision date will be established 90 days from the date of rceeipt of all of the requested information.
Additionally, if you have already published notice you will raced to republish notice, after the Division considers the
application submitted. This notice must be published once a week for four (4) consecutive weeks, starting within ten
(10) days of the date your application is considered submitted. We will notify you when you should initiate
republication of your notice. The final date for receiving comments is the 20th day after the fourth publication or the
next regular business day.
