I-Jarman $ <br />llepartmcnt of Minerals & Ccology <br />Subject: Appcat of Cessation Urder <br />Date: November 16, 200] <br />Per our discussion, this letter is to address the Cessation Orders (CO-200]-014 and CO-2001- <br />015) tlra! were issued to Lorcncity Coa] Co in Trinidad. Buckley Powder CO. is the blasting <br />contractor for this project at Lorencito Coal. We have been eontracKed by Lorencito Coal to load <br />and slrnot the overburden for their coal. When Lorencito received these orders, they sent them <br />onto Buckley Powder Co. to address the problem. <br />Buckley Powder Lo. is a 50% joint venture between the 13uckleys and Dyno Nobel, Inc. This <br />year we culchmtcd our 80`x' year in the explosive business in the Rocky Mountain Rc~ion. <br />Orit;finally, we only provided explosives to our customers. Then about 15 years ago, we started <br />the sholrock division of our company. This division now does mine design, drilling, loading and <br />blasting fix our customers. Our blasters are fully trained and have had the proper license <br />required to hlast iu Colorado for the pall IS years. In those I S years, we have bccu shooting at <br />the quarries and the construction sites. Unbeknownst to us, to shoot in a coal mine a difli:rent <br />license was rcyuired. Thus in October we started to load and shoot at I,oreircitn Coal. Once we <br />teamed that a different license was required to shoot al a coal mine, (the first cessation order) we <br />signed up 3 of our employees to lake the test. At that time, we contracted with a licensed hlastcr, <br />Jim Phillips, to oversee the blasting at Lorencito. Jim wtu only available for the 1 week (hc took <br />a week vacation from his regularjob at Trapper Mine to be on site for that week at Lorencito) <br />and our blasters took the license that Saturday (November 3"~). <br />'That Saturday, we were told that our 3 blasters passed the first 5 sections of the test (this part of <br />the test was mttltiplu choice and was graded by the proctor), however the last section was essay <br />yucstioru and wotdd he graded Monday by one of the board members. The blasters taking the <br />Icst were told shat we would be able to proceed with blasting at Lorencito once the test was <br />passed. 7'hc blasters were told they did not actually have to have the blasters license in hand, <br />vcr13a1 assrrrmce that the test was passed was enough to allow us to proceed with loading and <br />blasting. The actual license would be sent later. Assuming the tests to Ue graded Monday, we <br />told Lorencito that we could not shoot until Tuesday so we could get the results of the test. <br />
