Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Soaring Eagle Gravel Pit, Permit No. M-1999-025, Technical Revision No. 3 Adequacy Review `/ <br />Dear Mr. Settle: <br />DMG completed the preliminary adequacy review of your application for Technical Revision No. 3 (TR- <br />02) to Permit No. M-1999-025 for the Soaring Eagle Gravel Pit. The application cannot be approved <br />until the following issues are adequately addressed. Please submit a response to the following issues <br />as soon as possible, but no later than January 3, 2006 so the decision due date set for January 11, <br />2006 can be met. If your response or a written extension request are not received by January 3, 2006 <br />this application may be denied. <br />ADEQUACY ISSUES <br />1. Please revise the processing area acreage to make it accurate. <br />2. Please specify the settling pond area total acreage that needs to be reclaimed and provide <br />proposed reclamation details for the this area. <br />3. The proposed phase changes show the remainder of current Phase V being as new Phase II. <br />Please be aware that DMG will still hold Grand Junction Pipe and Supply Company to it's <br />commitment to not excavate current Phase V, VI, and VII (proposed Phase II, IV and V) until <br />engineered designs and financial warranty for the inlet structure are approved by DMG. In any <br />case, since part of current Phase V has been excavated, these plans and warranty will need to <br />be approved prior to the 2006 spring runoff season. To meet this timeframe, the design plans <br />must be submitted by no later than April 1, 2006. <br />4. Please revise the reclamation plan map to show the .2 (or more) acre wetlands detail for the <br />island. <br />5. The proposed reduction in acreage of current Phase VI (proposed to be Phase V) from 8.73 <br />acres to7.2 acres would require submittal of a release request for this undisturbed acreage. It <br />also removes the acreage designated for location of the flow-through inlet structure. Please <br />submit a release request for this acreage, per the requirements of Rule 4.17 of the Construction <br />Materials Rules and Regulations and include documentation that the U.S. Fish and Wildlife <br />Service no longer requires installation of an inlet structure to facilitate allow-through design for <br />this pit. Otherwise, please either restore the map to show original acreage and perimeter of <br />current Phase VI, or propose another alternative with supporting documentation. <br />Office of Office of Colorado <br />
