Cattany <br />Actin Division Director <br />Fort Collins, Col~orad~o 81501 <br />Re: Rifle Quarry, P" ermit No. M-1985-038, Receipt of Surety Increase and Reason to <br />Believe Letter (RTB- Withdrawal. r'" <br />Dear Mr. Golliher: <br />This Office has conducted a search for the Financial Warranty increase that.vvas required <br />after staff did a bond recalculation for the above referenced site in September of 2002. <br />The Denver Office did receive a Financial Warranty increase on November 12, 2002. The <br />documents were reviewed by Denver Staff and found to be incorrect. The documents <br />were sent back to Colorado Lien's parent company Pete Lien and Sons for corrections. <br />Unfortunately, the review and return of the documents were not completed until December <br />27`", 2002. Grand Junction Field Staff was not informed of the receipt or return of the <br />warranty documentation. This precipitated the Reason to Beiieve (RTB) letter sent out by <br />this Office on January 6t6, 2003 for "Failure to post adequate Bond within 60 days" as <br />required by Rule. <br />Field Staff would like to apologize to Colorado Lien for the RTB. First, clearly a substantial <br />amount of time lapsed between receiving the warranty documentation and the review. <br />Secondly, there was a breakdown in communication between the Denver Staff and Grand <br />Junction Field Staff that resulted in incorrect information being passed on about not <br />receiving the warranty documentation. Under normal circumstances if there are problems <br />with the warranty documentation, staff gives more time to correct the situation before <br />issuance of an RTB. Field Staff has asked for corrective measures to be instituted so that <br />this type of situation does not reoccur. <br />Although technically the increased warranty has not been received by DMG, the RTB is <br />being withdrawn at this time. However, Colorado Lien needs to supply the correct <br />documents as soon as possible to avoid any future Board hearing on this issue. <br />
