Along with this
approval, the Division would like to make clear what activities are being approved in this minor
revision, and what activities must wait for approval of Technical Revision 24.
1. The Division is allowing SCC to strip topsoil from and mine an additional 34.2 acres of
disturbed area not currently within the five year disturbance boundary. This area is
shown on the portion of Exhibit 20-1 submitted with the revision application. The
Division finds that the additional disturbance area will be effectively treated by Pond 006,
and that the existing performance bond is adequate to ensure reclamation of the
additional disturbed area.
2. SCC must ensure that runoff from this additional disturbance is directed to Pond 006,
without causing erosion of undisturbed areas and subsequent topsoil loss.
3. SCC may not construct the clean water diversion ditch proposed in Technical Revision
24 until final approval by the Division has been granted.
4. SCC may not alter the primary spillway of Pond 006, as proposed in Technical Revision
24, until final approval by the Division has been granted.
If you or your staff have questions or need additional information, please contact me.
Sincerely,
O ws
Susan L Burg ier
Environmental Protection Specialist
Enclosure
SLB\092995.WP
