You discussed this project with Bob Leachman on <br />August 14, 2001. <br />Based on your seazch of records and our log of Endangered Species Act consultations, it appeazs <br />there has been no evaluation of water use required to complete the mine reclamation plan. Any <br />water depletion in the Colorado River basin is considered a negative impact to the federally listed <br />fish occurring in the Colorado River. Consequently, before reclamation is considered complete, <br />the Division of Minerals and Geology should determine whether a net depletion of water results <br />from any of the tasks required to complete the reclamation. If a net depletion of water does <br />occur, formal consultation under section 7 of the Endangered Species Act will be required of <br />Office of Surface Mining prior to final approval of the reclamation. <br />Thank you for alerting us to this project.
