BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER <br />IN THE MATTER OF THE NOTICE OF VIOLATION ISSUED TO LAFARGE WEST, <br />INC. BLUESTONE PIT, FILE NO. M-1991-035. <br />THIS MATTER came before the Mined Lands Reclamation Boazd on January 22, <br />2002, in Denver, Colorado for a hearing on the notice of violation issued to LaFazge <br />West, Inc., in accordance with § 34-32.5-124, C.R.S. Tony Waldron appeared on behalf <br />of the Division of Minerals and Geology. Howard Harlan appeared on behalf of <br />Respondent LaFazge West, Inc. <br />The Board, having considered the Division's notice and the responses of the <br />Respondent, and having been otherwise fully informed in the premises, hereby enters the <br />following findings of fact, conclusions of law and order: <br />1. Respondent LaFazge West, Inc. (LaFarge) operates the Bluestone Pit, a Section 112 <br />sand and gravel mining op~ei-ation with permitted acreage o2 approximately >0? acres <br />and affected acreage of approximately 300 acres in Sections 4 and 9, T2S, R70W, 6`h <br />P.M., Jefferson County, Colorado. <br />2. On November 27, 2002, the Division inspected the Bluestone Pit. The inspector <br />discovered that LaFarge had affected approximately two acres outside the boundary <br />of is permit area. Specifically, the Division found an access road and stockpiles of <br />topsoil and overburden. The Division inspector determined that the violation had <br />continued for thirty-six days. The Division issued LaFarge a notice of violation based <br />on these findings, in accordance with C.R.S. § 34-32.5-124(1). <br />
