The Division has reviewed <br />the revised SAE demonstration for the Shaft 3 area submitted by Mountain Coal <br />Company. We are satisfied that the demonstration adequately justifies <br />designation of the Shaft 3 disturbance as a "small area exemption", as allowed <br />under Rule 4.05.2(3) and, that the alternate sediment control practices outlined in <br />the demonstration are in place, as indicated in the map accompanying the SAE <br />demonstration. <br />Thank you for your attention to this matter.
