Colorado 80203 <br />RE: PERMIT C-82-058; TECHNICAL REVISION 95-20; BATCH WEIGH LOADOUT <br />SYSTEM: ADEQUACY RESPONSES <br />Dear Mr. Gorham: <br />In response to adequacy issues raised in your letter of March 21, Twentymile Coal Company <br />(TCC) provides the following information for your review. Adequacy item responses are <br />presented in the order comments were revised permit materials are included in this submittal as <br />necessary. <br />Comment 1.) As we discussed with regard to water diversion for the coal waste pile, ditch D-1 <br />may be used with regard to the waste pile diversion and will need to be sized for the 100yr, <br />24hr rainfall event in that circumstance...... <br />Response 1.) Ditch D-1 as presented under TR-20 will not be utilized as part of the waste pile <br />diversion. TR-21 to be submitted shortly details the waste pile diversion design which includes <br />the establishment of a 100-year, 24-hour diversion above the proposed construction site of the <br />batch weigh loadout system coal stockpile. <br />Comment 2.) Have the proper changes been made or contemplated with regard to the NPDES <br />permit and Pond C receiving, and possibly discharging, wash down water from the batch weigh <br />system? <br />Response 2.) Mr. Jon Kubic with CDPHE has been contacted with regard to the potential need <br />to modify the NPDES permit applicable to Pond C. TCC does not believe a modification of this <br />nature is warranted given the negligible quantities of water anticipated to be generated from the <br />wash down process, the historical "dry' pattern typically exhibited by the pond, and the fact that <br />wash down water from the batch weigh loadout facility will be essentially identical to runoff <br />water normally conveyed to Pond C from the Tipple 2 coal stockpile area. <br />Comment 3.) The two sumps and the temporary diversions are not shown on Map 24. <br />
