M-82-129 <br />Dear Mr. Goemmer. <br />On June 27, 1997, the Division field inspected your mining operation and found only the problem of <br />no identifying sign at the entrance to the pit area. ~ <br />Subsequently, the file was reviewed and it was discovered that in a January 20, 1994 inspection <br />report you were required to increase your reclamation bond to $12,000 by April 27, 1994. That <br />increase was required to cover the cost of reclamation at your mine site while the Division and the <br />Boazd were considering a possible violation for affecting land outside the permit boundary and <br />during the time you were amending your permit under a Board Order. On July 22, 1997, in an <br />adequacy letter regarding your amendment application your bond was recalculated at $11,000 and <br />you were required to post the bond by September 20, 1994. You have not met either of these <br />deadline dates. <br />As part of the June 27, 1997 inspection report, the reclamation costs were calculated again. This <br />time you aze required to provide an $11, 050 bond by September 15, 1997. You were informed that <br />the matter of failure to provide an increased bond would be scheduled for a hearing before the <br />Mined Land Reclamation Board at their August 27-28, 1997 meeting. This was in error, since your <br />deadline date is September l5, 1997, we will instead schedule the hearing for the Boards' <br />September 24-25 meeting. If you provide the increased bond by the September 15th date, we will <br />withdraw the matter from the Boards' meeting agenda. <br />Please call Lavem Lemay in our office at 303-866-3567 if you need assistance with bond forms or <br />bond information.
