Stenzel °WINNING MOVES"
Colorado Water Resources Division
1313 Sherman St., Room 818
Denver, Colorado 80203
~ III IIIIIIIIIIIII III
RE: Sterling Sand & Gravel Co.; Home Office Mine; Amendment permit application
for the Colorado Mined Land Reclamation Division.
Dear Dick:
Attached is a copy of the above amendment application as submitted to the CMLRD.
The amendment combines four existing permitted areas into one composite permit
area. The following permits are involved:
M-77-439; Pit #1
M-77-440; Pit #2
M-78-256; Reclamation Pit #1
M-86-049; Seaworth Pit.
• Under the amendment, areas of planned excavation and estimates of final pond
extent have been revised such that the surface area of ponds as presen~ed in
the original permits has changed. Our concern is to obtain written assurance
from the Colorado Water Resources Division that ponds that did not require
augmentation under the original permits does not require augmentation when
combined by this amendment.
Under Exhibit F - Reclamation Plan Map, the approximate extent of final pond
surface area is portrayed. The surface area in acres is detailed for each pond
under Table VIII - Pond Surface Acreage and compared with the surface area in
acres of the ponds as originally permitted. Ponds created prior to 1973 are
not included and are not considered affected land even though they fall within
the amended permit area.
Table VIII, indicates that the surface area of ponds proposed by the amendment
is now less than the total surface area of ponds not requiring augmentation under
the original permit. The operator requests acknowledgement that augmentation
will not be required for the pond areas presented in this amendment until and
unless the final surface area in acres exceeds the total surface area in acres
of ponds as represented under the original permits. In such an .event, augmentation
would be required and complied with to the extent that the difference between any
future excess pond surface area exceeds the surface area of ponds as represented
in the original permits. The maps given in the original permit which represent the
the pond surface areas are compiled and included here-in for your reference. Since
the Seaworth Pit (M-86-049) is under augmentation, it is not to be considered as
part of the concern expressed in this letter.
. Thank-you for your time and kind assistance, ~~\ '
Sincerely, Bradford Janes, President
1510 York St., Ste. 329 • Denver, Colorado 80206 • (3031393-0214
