BMR's response to the <br />Division's additional adequacy comments is submitted in compliance with Abatement <br />Requirement No. 12 which was imposed pursuant to the Colorado Mined Land Reclamation <br />Board's May 28, 1992 Order. BMR believes that the enclosed responses address all of the <br />additional comments provided to BMR by the Division on June 30, 1992. BMR intends to <br />commence the procedures set forth in the sampling and analytical protocol upon receipt of <br />final approval from your office. <br />You will note that the enclosed document includes responses which reflect the fact <br />that your office has selected RCG/Hagler, Bailly, Inc. and Core Laboratories as the <br />independent sampling and analytical contractor respectively. BMR understands that your <br />decision in this regard is made in the context of this technical revision (""~'R-006") and has <br />forwarded a copy of the Agreement for Environmental Consulting Serviceg, Scope of Work <br />and Memorandum of Understanding as approved in your letter of August 2'"/ to Anne Maest <br />for review. We hope to conduct any necessary discussions regarding the contract as soon <br />as possible. As you know, TR-006 is an attachment to the contract and we will require a <br />final decision prior to execution of the contract with RCG/Hagler, Bailly, Inc. We will <br />contact you next week to ensure coordination between the review and approval process for <br />TR-006 and the contract discussions. We remain committed to resolving any remaining <br />issues and obtaining final approval and implementation as soon as possible. Please don't <br />
