The following adequacy comments follow the format of the permit <br />for easy reference. Division records indicate that a decision on the renewal <br />application is due by July 14, 1987. Your prompt response to these comments <br />will facilitate the meeting of that deadline. <br />Permit Form - <br />The disturbance to date should be included in the "Actual" column on <br />page 3 of the renewTform. The "proposed" column should list only <br />new areas added to the permit for the renewal term. In your case <br />this would be zero, as all disturbance has been previously <br />approved. A revised page 3 has been included in an effort to <br />clarify these requirements. In addition, the new application form <br />contains an increase in the life of mine surface ownership from 5165 <br />to 5444 acres. It would be helpful if Colowyo could submit a list <br />of the changes included therein, and any revisions of which these <br />changes were part. <br />Rule 2.04 Environmental Resources <br />On pages 2.04.4-2 and 2,04.4-5, it is stated that the archeological <br />report on the rail spur has been submitted to the Division, <br />However, the Division cannot find a copy of this report in our <br />records. The operator should submit one copy of this report, <br />A page marked "confidential" should be numbered 2.04,6-7 and <br />inserted into the permit. <br />In sections 2.04.6-8 and 4.14,1, the permit discusses overburden <br />swell factors. It was noted in the review that the original permit <br />estimated swell at 17%, the new permit estimates swell at 20%, and <br />the current monitoring data indicates a swell of 18~, Based on <br />these figures, the post mining topography may vary by as much as + <br />11 feet.
