LOng <br />Division Director <br />Re: Eagle No. 5 and 9 Mines (Permit No. C-81-044) <br />Technical Revision No. 26 (Extension of North Mains) <br />Dear Assistant Supervisor: <br />Pursuant to Title 34, Article 33, of the Colorado Revised Statutes, the <br />Division of Minerals and Geology hereby issues notice that on January 27, <br />1995, a technical revision application for a permit to conduct coal mining <br />operations by Cyprus Empire Corporation, P.O. Box 68, Craig, CO 81626, was <br />deemed complete for the purposes of filing. All reviews and comment periods <br />as provided in the Act and Regulations promulgated thereunder initiate from <br />this day of filing. <br />The applicant proposes to revise underground coal mining operations at the <br />Eagle No. 5 and 9 Mines. The technical revision pertains to extension of main <br />entry development and revised timing of development. <br />The area pertinent to this revision is located approximately six miles south <br />of Craig, Colorado, in portions of Sections 30 and 31, Township 6 North, Range <br />91 West, 6th Principal Meridian. These tracts of land are shown on USGS 7.5 <br />minute Quadrangle map of Round Bottom. <br />Because the above referenced technical revision application might alter <br />previously approved permit conditions or mitigation measures, we are <br />requesting your agency's evaluation of the potential for impacts to threatened <br />or endangered species of plants or animals, or wildlife species otherwise <br />protected by federal law. Applicable sections of the revision application are <br />enclosed. Please advise us if you require additional information. <br />In order for us to comply with regulatory time frames, we request that <br />comments be submitted to the Division of Minerals and Geology at the above <br />address by 5:00 p.m. on February 25, 1995. If no comments are received by <br />this date, we will proceed on the assumption that your agency has no concerns <br />with or objections to the applicant's proposal. <br />A copy of the technical revision application is available for public inspec- <br />tion at the Moffat County Courthouse, West Victory Way, Craig, Colorado. <br />
