We find it <br />incomplete with respect to information required by both Rule 3.03.211) and by our <br />recommended :submittal format outlined in the enclosed Handbook Memorandum entitled <br />Bond Release on Permanent Program Areas. Please provide the following information to <br />make the application complete: <br />11 The date the permit was approved; <br />2) The acreage for which release is requested; <br />3) The legal description of the site; <br />4) Copies of the written notice to seek release to parties <br />identified in Rule 3.03.2(1); <br />5) The affidavit of publication indicating that Kaiser is seeking <br />release on the site per Rules 3.03.2(1)(bl and ic) and <br />2.07.312); <br />61 The map and table documenting the topsoil replacement <br />depth; <br />7) The vegetation map showing both the reference area and the <br />reclaimed areas. <br />On a related matter, the determination of the completeness of an application does not <br />have any bearing on the Division's decision to grant Phase II Bond Release. As such, we <br />would like to take this opportunity to forewarn you of a concern we have regarding the <br />revegetation success at the mine. As you are aware, the Division sampled at the site on <br />September 1 and 2, 1992. The Division found that the reclaimed area had attained 31.6 <br />percent vegetal:ive cover and the reference area had 44.75 percent, demonstrating that <br />only a 70.6 percent cover had been established. These figures seemed to vary <br />significantly from the 28.6 percent and 28 percent (101.2 percent) found by your <br />sampling. This discrepancy suggests that the Division should re-sample the site next <br />summer prior to any decision on bond release. <br /> <br />
