Box 487 D~.~ aun I)uer nu <br />Walden, Colorado 80480 <br />RE: Minor Revision to Revise Design Capacity for Ditches B-1 and B-2 in 720 Pit Area, <br />Marr Strip Mine (C-80-006) <br />Dear Mr. Patterson: <br />The Division has received your request for a minor revision to change the designs for ditches B-1 <br />and B-2 from a 100 year design to a 25 year design. This revision, since it constitutes "design <br />changes for regulated structures" should be a technical revision. The Kerr Coal Company and the <br />Division are currently in the adequacy review period for a phase I bond release. Part of the <br />Division's bond release adequacy deals with concerns that have arisen with these ditches. With your <br />concurrence, the Division would like to review any design changes to the ditches within the bond <br />release adequacy since the final designs may change again.
