The following area -ist of issues that require either <br />additional information or revision prior to final approval: <br />The Division conducted an AVS check for the Chimney Rock Mine permit renewal. The <br />system recommendation is DENY. There appear to be nine violations associated with a West <br />Virginia Mine, permit number U069400, which include state civil penalties, audit violations <br />and one bond forfeiture. A copy of the AVS Report is attached to aid in resolving this <br />matter. <br />2. The Applicant Violator Systems (AVS) list a number of owners and controller that are not <br />included on the revised permit pages. The following owners and controllers were noted in <br />AVS, but omitted from the permit: <br />Daniel Lazson- President 2/2/89 <br />Kenneth RCasey- Director 6/3/93 <br />Pension Benefit Guarantee Co.-Shareholder 8/1/91 <br />If these owners and controllers are no longer associated with Kaiser Ventures, then proof of <br />termination and end dates are required. Proof can be in the form of a resignation letter or <br />corporate minutes. <br />3. Volunteer Employees Benefit Association and Pension Benefit Guarantee Co. are listed in <br />the AVS as shareholders of Kaiser Ventures. The operator did not list the officers and <br />directors for either company. All owners and controllers of the applicant need to comply with <br />
