Please respond at your earliest convenience so that
we may issue a decision no later than the previously specified decision date
of March 14, 1992.
1.) Please submit more detailed water quality analyses for the proposed
permanent ponds. We acknowledge receipt of the Discharge Monitor
Reports; however, two of the three indicate "No discharge". It will be
necessary to show, more definitively, that the water retained in the
ponds will be suitable for the intended use. Analyses should include
such parameters as pH, total dissolved solids, and representative metal
analysis such as iron, manganese, magnesium, etc. (4.05.9(1)(a) >
2.) Please provide the specific surveys, reports, etc., used to conclude that
pond water levels range from 0.5 feet to 3,5 feet (4.05.9(1)(b) ).
3.) The submitted information regarding Rule 4.05.9(1)(4) seems to conflict
with the statements provided regarding the Rule 4.05.9 (1)(b). The ponds
must retain water to be approved as permanent, and we must make the
finding that the water level is sufficiently stable so that they indeed
function as impoundments. If more than two acre feet of water are
impounded, then the water rights issues must be addressed.
Specifically, please indicate the amount of water that will be retained
in each pond below the primary dewatering outlet. Do you plan to gate
the outlets to provide for any additional storage? Also, please indicate
the manner in which you intend to address the enclosed letter from the
State Engineer (dated January 28, 1992). (Rule 4.05.9(1)(4) )
